A compliant DOT hire is more than a drug test

Testing is one of four things that must happen before a CDL driver turns a wheel for you:

  1. Pre-employment drug test — verified negative received before the first safety-sensitive duty.
  2. Full FMCSA Clearinghouse query — with the driver's electronic consent given in the Clearinghouse itself, checking for unresolved violations.
  3. Previous employer records request — DOT testing history from all DOT-regulated employers over the previous three years.
  4. Driver qualification file — the surrounding paperwork that an auditor will open first.

The gap that catches carriers: a clean drug test but no Clearinghouse query. If the driver has an unresolved violation on file, putting them behind the wheel is a violation by you — regardless of how clean the test was.

When you can skip the test (and when you cannot)

DOT rules provide a narrow exception where a driver has participated in a compliant testing program within the previous 30 days and has not been out of a random pool for more than 30 days — with documented verification obtained from the prior employer. The exception is narrower than most people think, and the documentation burden is real. In practice, unless you are certain, test. It is cheaper than the finding.

Non-DOT hiring works differently

For non-safety-sensitive roles, your policy governs. Most employers make the offer contingent on a negative result and run a 5- or 10-panel screen. Some add hair testing for a 90-day lookback on senior or high-risk hires. Whatever you choose, apply it consistently to every candidate in the same role — inconsistency is what turns a routine screen into a discrimination claim.

What happens if the result is not negative

Our MRO handles the donor interview before you ever see a verified result, so a legitimate prescription is resolved confidentially and never becomes your business. If the result verifies positive, the candidate cannot perform safety-sensitive functions, the violation is reported to the Clearinghouse, and they must complete the SAP return-to-duty process before working for anyone in a DOT role.
